By accessing or using PutYourName ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. User Accounts

To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.

3. Marketplace Rules

PutYourName is a marketplace that connects sellers of personalized, culturally-inspired products with buyers. All users must adhere to the following rules:

• Products must be accurately described and represented in listings.
• Cultural content must be represented respectfully and authentically.
• Users must not engage in fraudulent, deceptive, or misleading practices.
• Prohibited items include counterfeit goods, offensive content, and items that violate any applicable laws.

4. Seller Obligations

As a seller on PutYourName, you agree to:

• Provide accurate product descriptions, images, and pricing information.
• Fulfill orders in a timely manner and communicate with buyers regarding order status.
• Comply with all applicable laws and regulations, including consumer protection and tax requirements.
• Maintain a valid Stripe Connect account for receiving payments.
• Handle personalization requests according to the specifications provided by buyers.

5. Buyer Rights

As a buyer on PutYourName, you have the right to:

• Receive products that match their descriptions and any agreed-upon personalizations.
• Request assistance from PutYourName support if an order is not fulfilled as described.
• Access clear information about pricing, including any personalization fees.

6. Payment Terms

All payments on PutYourName are processed through Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these terms.

• PutYourName charges a 10% platform fee on each transaction, which is deducted from the seller's payout.
• Sellers receive payouts directly to their connected Stripe accounts after the platform fee is deducted.
• Prices displayed on the Platform include any applicable taxes as determined by the seller.
• Refund policies are managed by individual sellers, subject to applicable consumer protection laws.

7. Intellectual Property

Sellers retain ownership of the intellectual property in their product designs and listings. By listing products on PutYourName, sellers grant the Platform a non-exclusive license to display and promote their products. Users must not copy, reproduce, or distribute any content from the Platform without permission from the respective owner.

8. Limitation of Liability

PutYourName provides the Platform on an "as is" basis. To the fullest extent permitted by law, PutYourName shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. PutYourName acts as a marketplace facilitator and is not a party to transactions between buyers and sellers.

9. Termination

PutYourName reserves the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Sellers will receive payouts for any completed orders, less applicable fees.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting the updated terms on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms.
